Attorney Pleads Guilty to Tax Evasion – He should have hired SELIG & Associates

He Prepared Tax Returns for Clients and Omitted Over $1.5 Million in Income on His Own Tax Returns  A former attorney, who also prepared tax returns for clients, pleaded guilty to tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman and Josh J. Minkler, U.S. Attorney for the Southern District.
Scott C. Cole, 54, pleaded guilty to one count of tax evasion for his multi-year effort to evade the payment of taxes and penalties on income he failed to report on his 2002 tax return.
According to the Superseding Indictment and court filings, Cole was an attorney and preparer of tax returns. As the result of Internal Revenue Service (IRS) audits of Cole’s 2001 and 2002 tax returns, the Tax Court and the United States Court of Appeals determined that Cole owed over $1,000,000 in taxes and penalties, stemming from Cole’s fraudulent omission of over $1.5 million of income from his individual tax returns for those years.  From 2011 through 2017, when the IRS sought to collect those taxes, Cole took various steps to evade payment of his tax debt. His efforts included opening bank accounts in the names of nominees, such as family members, directing payment for legal and tax preparation services performed by him be made payable to nominee companies he controlled, paying personal bills from bank accounts maintained in the names of nominees, and dealing extensively in cash and money orders. Cole also prepared tax returns for clients that omitted his name as the paid preparer of those tax returns, a violation of the Internal Revenue Code and related regulations.  Because of Cole’s acts of evasion, the IRS collected less than $3,000 of the total tax debt Cole owed for the 2001 and 2002 tax years.
Cole resigned from the bar following the filing of a complaint by the Disciplinary Commission in 2014, which charged Cole with the filing of fraudulent tax returns with the IRS and the State for the 2001 and 2002 tax years.
U.S. District Judge Jane Magnus-Stinson, who presided over Cole’s guilty plea yesterday, is expected to schedule Cole’s sentencing for late summer 2019.
Principal Deputy Assistant Attorney General Zuckerman and U.S. Attorney Minkler commended special agents of IRS-Criminal Investigation, who investigated the case, the IRS Revenue Agents, who conducted the underlying audits, and the prosecutors on the case, Assistant United States Attorney James M. Warden from the Southern District and Assistant Chief Stanley J. Okula, Jr. of the Tax Division.

Don’t be Victimized by Scam Tactics this Filing Season

Stay vigilant to thwart identity thieves and fraudsters

The New York State Department of Taxation and Finance today urged taxpayers to remain vigilant and guard against scams during the tax filing season. Strategies used by scammers to steal private information can be as simple as a phone call or as sophisticated as a phishing campaign to install malware on victims’ home computers.

“It’s a nonstop battle to identify and prevent fraud by identity thieves and scam artists,” said New York State Taxpayer Rights Advocate Margaret Neri. “The Tax Department is constantly updating its award-winning analytics to keep pace with these criminals, but it’s also critical for taxpayers to be alert to common scam tactics and protect themselves.”

Telltale signs of a scam

Threatening calls: Scam artists who use this tactic try to bully or trick victims into disclosing private information, or convince them to wire money to pay a tax debt or fine. If a caller, perhaps posing as a New York State Tax Department or IRS agent, threatens arrest it’s a scam. Neither agency threatens taxpayers, and they notify taxpayers by letter first before making any calls or sending any emails.

Unusual emails: Phishing emails often contain links that activate malware or lead to phony websites that request personal information. Misspellings or unfamiliar logos in the email or subject line are obvious clues that it’s a scam attempt, but some of the bogus emails and websites are convincing. Hovering over the links may reveal an unusual webpage address (URL) that confirms the sender’s true intent. To be safe, simply delete these emails and any that are unsolicited, and never click the links within them.Remember, the Tax Department never requests personal or financial information by email.

Offers to collect a tax payment in person: If a caller claiming to be from the Tax Department or IRS offers to meet you at a specified location to collect a payment, it’s a scam. This is never an option with the IRS or Tax Department. End the call immediately.

Requests for a specific type of payment: If you’re being told to pay through a prepaid debit card or an iTunes gift card, this is an obvious sign of a scam. The Tax Department and IRS provide various payment options, but the use of gift cards isn’t one of them.

Report it If you are a victim, or believe you may be a potential victim of tax-related identity theft, alert us immediately. We will track your information to help keep it private and protected. Visit the Tax Department’s Report fraud, scams, and identity theft webpage.

David Selig is warning New Yorkers about a sophisticated new phishing scam called “Conversation Hijacking”

With tax season upon us David Selig is warning New Yorkers about a sophisticated new phishing scam called “Conversation Hijacking”. In a nutshell, internet scammers gain access your ongoing email conversations, and send the participants messages containing malicious links or attachments. It looks 100% legit says Selig. Victims click the link or open the attachment and Whammy! The scam is so pervasive that even Florida’s Attorney General Ashley Moody said: “As technology evolves, so do the methods scammers use to bypass security and trick users into compromising sensitive information. Conversation hijacking attacks are the latest trick being used to steal people’s identities and access their financial information. Floridians should remain cautious and avoid clicking on links or opening attachments that seem suspicious.” Agreed.

The Straight Dope

1.   Don’t share passwords or login credentials
2.   Change passwords frequently
3.   Maintain a strong password that utilizes numbers and special characters and avoiding common words, birth dates, or other easily discernable terms
4.   Don’t click on unsolicited links or download any unsolicited files without verbally verifying the authenticity with the sender through another means of communication, such as a phone call; and Ensure systems and devices are updated with the latest operating systems, security patches and antivirus software

Businesswoman Sentenced to Prison for Filing False Corporate Income Tax Return (she should have hired SELIG)

Marlene Seo was sentenced of February 1st2019 to one year and one day in prison for making and subscribing a false corporate income tax return, announced Principal Deputy Assistant Attorney Richard E. Zuckerman, head of the Justice Department’s Tax Division.
According to court documents, Seo owned and operated the National Martial Arts Academy (NMAA).  From 2011 through 2013, she directed that income due to NMAA to be deposited into certain bank accounts, which she did not disclose to her bookkeeper and accountants.  As a result, Seo caused the 2011, 2012 and 2013 federal corporate income tax returns for NMAA to underreport the business’s gross receipts by approximately $650,000.
Seo pleaded guilty on October 29, 2018, to signing and filing NMAA’s false 2012 income tax return.  In addition to the prison term, Seo was ordered to serve one year of supervised release and to pay restitution to the Internal Revenue Service (IRS) in the amount of $238,350.70 and a special assessment of $100.
Principal Assistant Attorney General Zuckerman commended special agents of IRS-Criminal Investigation, who investigated the case, and Trial Attorneys Anahi Cortada and Lisa L. Bellamy of the Tax Division, who prosecuted the case.

CPA Sentenced to 8 Months in Prison

Marc Howard Berger was sentenced today to 8 months in prison for aiding and assisting in the filing of false tax returns, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division, United States Attorney Alex G. Tse, Federal Bureau of Investigation (FBI) Special Agent in Charge John F. Bennett, and Internal Revenue Service, Criminal Investigation (IRS-CI) Special Agent in Charge Tara Sullivan.
On July 18, after a three-week jury trial, Berger was found guilty of willfully assisting in the preparation of three false Forms 1040 for codefendant G. Steven Burrill for the 2011, 2012, and 2013 tax years.  Evidence at trial showed that Berger, 68, of Walnut Creek, California, was a Certified Public Accountant and partner with a regional tax preparation firm, Burr Pilger Mayer.  Berger’s client, Burrill, was the owner and CEO of Burrill & Company, Burrill Capital, and a number of related entities.  Through those entities, Burrill managed venture capital funds, including Burrill Life Sciences Capital Fund III L.P. (the Fund), a $283 million investment fund focused on the life sciences industry.  Between Dec. 2007 and Sept. 2013, Burrill transferred more than $18 million from the Fund to his management companies, a sum in excess of the management fees that were due and allowable under the agreements that governed the Fund.  Berger intentionally prepared and filed false income tax returns for Burrill that failed to report more than $18 million in income, resulting in unpaid taxes of more than $4.7 million.  With Berger’s assistance, Burrill did not pay individual income taxes for the years 2009 through 2013.
Berger was indicted by a federal grand jury on Sept. 14, 2017.  Berger was charged with three counts of willfully aiding and assisting in the preparation of three false Forms 1040 for Burrill for 2011, 2012, and 2013.
The sentence was handed down by The Honorable Richard Seeborg, U.S. District Court Judge.  Judge Seeborg also sentenced the defendant to one year of supervised release and a $20,000 fine. The defendant will begin serving the sentence on July 8, 2019.
Burrill pleaded guilty on Dec. 7, 2017, to one count of investment-adviser fraud, in violation of 15 U.S.C. §§ 80b-6 & 80b-17, 18 U.S.C. § 2, and 17 C.F.R. § 275.206(4)-8, and one count of filing a false income tax return, in violation of 26 U.S.C. § 7206(1). He was sentenced to 30 months in prison on December 4, 2018.

Tax Return Preparer Convicted of Filing False Income Tax Returns (he should have hired Selig and Associates)

A man was convicted by a federal jury today in the U.S. District Court for the Southern District of ten counts of aiding and assisting in the filing of false income tax returns and three counts of filing false income tax returns announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Ariana Fajardo Orshan.
According to court documents and evidence presented at trial, from 2012 through 2015, Richard Maurival prepared income tax returns for clients that claimed false education credits and false business expenses, and other deductions to inflate by thousands of dollars refunds paid by the Internal Revenue Service.  In addition to filing fraudulent income tax returns for his clients, Maurival falsified his own income tax returns, by not fully reporting the fees he earned in his tax preparation business for tax years 2012, 2013, and 2014.
U.S. District Judge James Ivan Cohn for the Southern District set sentencing for January 17, 2019. The defendant faces a maximum possible sentence of 3 years in prison on each count, as well as a period of supervised release, restitution, and monetary penalties.

The IRS sent me a certified letter (what does it mean?) + IRS Forms and Publications + SELIG & Associates + PRO BONO Tax Representation

Certain cases demand discretion, e.g. prominent and high profile individuals, business owners, sex industry workers and people who received undeclared income and are now facing unrelated criminal charges. To this end, in 2017 Selig & Associates represented 3 professional athletes, 5 on-air television personalities, 2 famous actresses and a former ADA. And because each case was resolved so discreetly - you'll never know who they were. Conversely, certain cases capture the public’s attention. Accordingly, Selig & Associates has the ability to take your high profile tax-case public by appearing on national television and by holding in-office press conferences that are aired on local television and radio programs.
FYI Selig & Associates will never publish a “client-testimonial” or otherwise violate the sanctity of confidentiality. Accordingly, when you have a serious tax problem (that needs to be solved) you can speak to us with complete confidence.
We're committed to bettering the community in which we practice. This is why David Selig and Bradley Dorin have from time to time agree to waive or reduce their fees. In this capacity, we’ve helped Veterans, nonprofits, the clergy, the wrongly accused, senior citizens, private schools and daycare centers.
If you have a tax problem that you’d like us to consider either as a pro bono or as a reduced rate client, or if you’d like to assist or support our efforts in this challenging forum, please call Selig & Associates directly.
CP504 Notice: You have an unpaid amount due on your account. If you do not pay the amount due immediately, the IRS will seize your state income tax refund and apply it to pay the amount you owe.
CP72 Notice: You may have claimed a frivolous position on your tax return. A frivolous return is identified when some information on the return has no basis in the law (proceed with extreme caution).
CP523 Notice: The IRS is terminating your installment agreement and will seize your assets. Why? Because you defaulted on your agreement (silly).
CP75D Notice: The IRS is auditing your tax return and needs documentation to verify the income and withholding you reported on your tax return. This may affect your eligibility for the Earned Income Credit, dependent exemptions and other refundable credits that you claimed. Accordingly, the IRS is “holding” your refund pending the results of the audit.
CP16 Notice: The IRS sent you this notice to tell you about changes they made to your return that affect your refund. The IRS made these changes because they believe there was a miscalculation. The records show you owe other tax debts and the IRS applied all or part of your refund to them.
CP19 Notice: The IRS has increased the amount of tax you owe because they believe you incorrectly claimed one or more deductions or credits.
CP23 Notice: The IRS made changes to your return because they found a difference between the amount of estimated tax payments on your tax return and the amount they posted to your account. Accordingly, you now have a balance due.
CP39 Notice: The IRS used a refund from your spouse or former spouse to pay your past due tax debt (informally referred to as the “mother of all arguments”)

Trump Orders IRS to Change Rules - First Time Penalty Abatements Limited to One Year

The IRS is ramping up collections and taxpayer’s are feeling the squeeze, says David  Selig  of  Selig  &  Associates. IRS audits have become more contentious, collections have become more invasive and punishments for breaking the rules are bordering upon cruel and unusual.

And if that wasn’t enough, the IRS just changed its first-time penalty abatement policy (and its a change is for the worse). Under the new rules taxpayers are no longer allowed to combine multiple liabilities and penalty abatements are limited to just one-year, and only one tax type.

The policy change is largely due to perceived abuses. For example, in 2016 David Selig and Bradley Dorin of Selig & Associates gained national attention when they represented an institutional stock trader and successfully discharged ONE HUNDRED AND TWENTY ONE MILLION DOLLARS (“$121,000,000”) in tax and penalty liabilities.
About Selig & Associates: Selig & Associates is a boutique tax firm with offices in New York City. The principals David Selig and Bradley Dorin have worked together for the past 10-years and are as different as day and night. Selig is a 6”2 former Marine with a penchant for heavily starched shirts, Versace ties, gold cufflinks and spit shined shoes. Conversely, Dorin prefers casual clothing and comfortable shoes, a near-vegetarian diet and the melodious stylings of the Grateful Dead.

Selig & Associates is one of New York City’s best-kept secrets because Selig and Dorin specialize in settling tax cases without going to Court. In a nutshell, they’re fixers. Or to paraphrase Dickens, they employ every trick ingenuity can devise.

Having saved their clients over $300,000,000 in federal and state taxes, it’s obvious that Selig and Dorin aren’t your typical accountant attorney duo. Our clients only see the results says Selig. They don’t see the hours of preparation that takes place behind the scenes.

Selig is a Federal Tax Practitioner and Public Adjuster and Dorin is a tax attorney with over 33 years experience. The firm is hidden away on the 16thfloor of a nondescript building in the shadow of Seventh Avenue.

We fly beneath the radar says Attorney Dorin. Our clients want anonymity and we do our best to keep them out of the courtroom and out of prison.

Selig & Associates represents professionals, business-owners and outlaws of every stripe. And during the entirety of their 10-year association not a single client has been convicted of a tax related felony. We’re extremely selective about the cases we take, says Selig. For example, I favor acrimonious contests with high stakes while Dorin prefers to negotiate terms and conditions. To be continued . . .

Only Love Can Break Your Heart - Death & Tax Evasion

A paralegal specialist for the FBI pleaded guilty today to embezzling nearly $160,000 in government funds, announced Acting Assistant Attorney General John P. Cronan of the Justice Department’s Criminal Division and Special Agent in Charge James K. Cheng of the Department of Justice Office of the Inspector General’s Field Division.
Lynn M. Morris, 51, pleaded guilty to one count of embezzlement of government property.  Morris will be sentenced on June 4 before U.S. District Court Judge Larry Alan Burns of the Southern District.
According to admissions made in connection with her guilty plea, between July 2014 and November 2016, Morris embezzled approximately $159,821.90 that belonged to the United States and converted the funds for her own personal use.  The funds were held in an account owned by the FBI Division’s Asset Forfeiture Unit (AFU).  From 2014 to 2016, Morris was a paralegal specialist and the designated coordinator for the AFU.  Morris admitted that to convert government funds to her own use, she used her knowledge and position within the FBI to withdraw cash from the AFU’s account and deposited portions of the stolen proceeds into her personal checking account.
The Department of Justice Office of the Inspector General investigated the case.  Trial Attorneys Marco A. Palmieri and Jessica C. Harvey of the Criminal Division’s Public Integrity Section are prosecuting the case.
