Man Pleads Guilty to Tax Evasion - Better call Selig & Associates



A man pleaded guilty to tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Jay E. Town. According to court documents and statements made in court, in 2011, John P. Cooney, 70, filed delinquent tax returns for 2008 through 2010, in which admitted that he owed the Internal Revenue Service (IRS) approximately $780,000, but did not include any payment. Rather, to evade his tax obligation, Cooney created a nominee entity, GVA Advisors, LLC (GVA), and directed that income from his employer and dividends from his investments be paid to an account in GVA’s name, rather than to him directly. From 2013 through 2016, Cooney deposited more than $435,000 into the GVA account, concealing the funds from the IRS. In all, as result of his actions, Cooney owed by 2017 more than $1.3 million in outstanding balances, penalties, and interest to the IRS. Sentencing is scheduled for May 28, 2020.  At sentencing, Cooney faces a statutory maximum sentence of five years in prison.  He also faces a period of supervised release and monetary penalties. Pursuant to the plea agreement, Cooney has agreed to pay restitution of $1,311,904 to the United States.

Topic No. 306 Penalty for Underpayment of Estimated Tax. "I saw you (and him) walking in the rain"



The United States income tax system is a pay-as-you-go tax system, which means that you must pay income tax as you earn or receive your income during the year. You can do this either through withholding or by making estimated tax payments. If you didn't pay enough tax throughout the year, either through withholding or by making estimated tax payments, you may have to pay a penalty for underpayment of estimated tax. Generally, most taxpayers will avoid this penalty if they either owe less than $1,000 in tax after subtracting their withholding and refundable credits, or if they paid withholding and estimated tax of at least 90% of the tax for the current year or 100% of the tax shown on the return for the prior year, whichever is smaller. There are special rules for farmers and fishermen, certain household employers and certain higher income taxpayers. For more information, refer to Publication 505, Tax Withholding and Estimated Tax.

Generally, taxpayers should make estimated tax payments in four equal amounts to avoid a penalty. However, if you receive income unevenly during the year, you may be able to vary the amounts of the payments to avoid or lower the penalty by using the annualized installment method. Use Form 2210, Underpayment of Estimated Tax by Individuals, Estates, and Trusts (PDF)  To see if you owe a penalty for underpaying your estimated tax.
The law allows the IRS to waive the penalty if:
1.    You didn't make a required payment because of a casualty event, disaster, or other unusual circumstance and it would be inequitable to impose the penalty, or
2.    You retired (after reaching age 62) or became disabled during the tax year or in the preceding tax year for which you should have made estimated payments, and the underpayment was due to reasonable cause and not willful neglect, or
3.    The underpayment was due to an inability to accurately calculate your estimated income tax payment due to the breadth of changes enacted by the tax reform.

Deducting Automobile Expenses in 2019 by David Selig of Selig & Associates



If you travel for business you’re allowed to deduct the dollar value of business miles you drove on your individual income tax return. Taxpayers can file their actual expenses incurred, or use the standard mileage rate, which is 58 cents in 2019. If you use your actual car expenses you should include payments, insurance, depreciation, registration, licenses, repairs and maintenance, garage rent (if applicable) along with parking and tolls.  Alternatively, if you use the standard mileage rate, you should keep a record of your millage, and be prepared to prove what percentage was for personal use and what percentage was for business.

TAX RETURN PREPARERS BEWARE: Owner of Long Island Tax Preparation Business Sentenced to Prison for Preparing False Returns

A former tax return preparer was sentenced to 24 months in prison today for aiding in the preparation of a false tax return, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division. According to court filings and statements made in court, Mariano Exantus owned and operated Latrex Multi Service, a tax return preparation business located in Uniondale, New York. From at least 2011 through 2016, Exantus prepared and filed fraudulent tax returns for his clients with the Internal Revenue Service (IRS) in which he inflated their refunds, or caused the clients to be issued a refund to which they were not legally entitled. On these returns, Exantus falsified itemized deductions and also claimed false credits, including the American Opportunity Tax Credit. Exantus’s conduct caused a tax loss of more than $250,000 to the United States. In addition to the prison term, U.S. District Judge Arthur D. Spatt ordered Exantus to serve one year of supervised release, and to pay restitution to the IRS. Principal Deputy Assistant Attorney General Zuckerman thanked special agents of IRS - Criminal Investigation, who conducted the investigation, and Trial Attorneys Carl Brooker and Sarah Ranney of the Tax Division, who prosecuted the case.

800 Cartons of Illicit Cigarettes, $63,500 in Cash & Vehicles Seized on Staten Island


The New York State Department of Taxation and Finance, along with U.S. Department of Homeland Security Investigations—Newark Office and the Richmond County District Attorney's Office, today announced felony charges against three Staten Island residents after executing seven search warrants on October 8.

Investigators searched a home and detached garage at 106 Catherine Street, four vehicles, and a safety deposit box at a nearby bank. In all, investigators seized 814 cartons of untaxed cigarettes, $63,525 in cash, four vehicles, and various documents, computers, and phones. They charged 43-year-old Fathy D. Seidi, 35-year-old Hashed D. Alsaidi, and 20-year-old Amjad F. Alseidi with multiple felonies, including possession of more than 30,000 untaxed cigarettes and attempt to evade the New York State cigarette and tobacco products tax. In addition to the criminal charges, the defendants face fines of up to $600 per carton seized.

McMahon said, “Possessing illegal cigarettes is a serious crime which cheats the public out of critical tax revenue, and the prosecutors in my office’s Economic Crimes Bureau work tirelessly to hold such offenders accountable. I’m very proud of the work that was done by my team on this case to get this illegal contraband and cash off the street.  We will continue our important partnership with the New York State Department of Taxation and Finance to ensure Staten Islanders are not deprived of valuable state resources and services.” The Richmond County District Attorney's Office is prosecuting this case. A criminal complaint is only an accusation; the defendant is presumed innocent until proven guilty.

Westchester County Man Pleads Guilty to Felony Criminal Tax Fraud (he should have hired SELIG & Associates)


The New York State Department of Taxation and Finance announced that one of New York State’s top tax debtors, David Walsh, pleaded guilty to second-degree criminal tax fraud, a C-class felony, in Albany County Court on the 2nd day of October 2019. 

Walsh, 58, of 9 Elm Rock Road, Bronxville, filed his New York State personal income tax returns but failed to pay the tax due for 2010, 2011, and 2014. He will pay all penalties and interest, which currently totals $573,259, in addition to the more than $2.24 million he’s already paid back to New York State. 

Walsh and his wife Gia surrendered to Tax Department investigators on September 20, 2018, and were charged with felony counts of criminal tax fraud. “Those who evade taxes in New York State deprive our communities of support for vital services and increase the burden honest taxpayers who play by the rules,” said New York State Commissioner of Taxation and Finance Michael Schmidt. “As this case demonstrates, those who commit tax fraud will be held accountable for their crimes.” David Walsh is scheduled to be sentenced December 6 in Albany County Court.

Guilty as Sin - Chiropractor Sentenced For Tax Evasion


Donald Gibson was sentenced to 33 months in prison for tax evasion and for presenting a fake financial instrument to the U.S. Department of Treasury. Gibson failed to file his 2004 through 2014 individual income tax returns and attempted to evade his income tax liabilities for these years by diverting money to a warehouse bank called MYICIS, cashing over $800,000 in business checks at a check-cashing facility and submitting fake money orders and bogus financial instruments to the IRS. Gibson  also formed Sovereign Christian Mission (SCM), a purported religious organization, as a way to further hide his chiropractic income and pay for his personal expenses. Gibson used SCM to pay for his groceries, entertainment, dinners, and car repairs. While the IRS was auditing his tax returns and later during the criminal investigation, Gibson presented a fake financial instrument purporting to be worth $300 million to the IRS and claimed that it paid off his income tax liabilities.
