NYS Tax Department Cancels Christmas – Seizes Employees Payroll


On December 20th 2019, just 4 days before Christmas, the New York State Department of Taxation and Finance seized over $20,000 from a small business’s Designated Employee Payroll Account. And as a direct and clearly foreseeable consequence of this enforcement action, a store-full of minimum wage workers weren't paid for two-weeks worth of work. 

In other words, the workers, who have absolutely nothing to do with the tax debt, have no money for Christmas. They have money for food. No money for transportation. No money for baby formula. No money for diapers, or for any other necessity that most of us take for granted. 

What makes this case so outrageous is that we were negotiating a payment plan whereby my client would pay the State $50,000 on Friday December 27th says David Selig of Selig & Associates. Then without warning the State went back on its word and seized the company’s entire payroll. 

Ironically, the only people the Tax Department actually hurt, were the company's minimum wage workers, who are almost exclusively women of color, and mostly single mothers, says Selig. 

But let’s keep it 100, says Selig, the State employees who carried out this financial pogrom are also people of color. So it’s hard for me to make sense of their actions, other than to say they’re just mean, and to a greater extent, foolish inasmuch as they consistently step over dollars to pick up nickels.

My client is a successful businessman who keeps an attorney and accountant on retainer. So when push comes to shove, he can always file for bankruptcy or pursue some other strategic course of action before the State can divest him of a single asset. 

Conversely, his minimum wage workers are extremely vulnerable because they live paycheck to paycheck. And if they don’t return to work (because they weren’t paid) our client may never have to pay them. But don’t get it twisted, says Selig. No one at the State gives a damn about minimum wage workers either, so it’s hard to find the moral high ground. Nevertheless, it’s still frustrating because I tried like the Devil to get the State to release this levy and pay the workers - but it was all for naught. 

On Tuesday December 24th 2019 the good folks at Metrotech refused to release the worker's pay, and eventually stopped answering my calls. I suppose the State employees went home to enjoy their paid holiday - while their undeserving victims are left to suffer. Seasons Greetings!

Another Dentist Indicted for Tax Evasion




A Federal grand jury indicted another dentist for tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Scott C. Blader.
According to the indictment, Frederick G. Kriemelmeyer, 70, operated a dental practice  In 2007, Kriemelmeyer was ordered by the U.S. District Court to pay $135,337 to the Internal Revenue Service (IRS) for unpaid individual income taxes.  By December 2012, the IRS had assessed Kriemelmeyer more than $450,000 in taxes, interest and penalties.  Beginning in approximately 2011, Kriemelmeyer allegedly took a number of actions to evade payment of this assessment. The indictment also charges that for the years 2013 through 2015 Kriemelmeyer failed to file tax returns and attempted to evade the taxes due on income from his dental practice. Kriemelmeyer allegedly sought to conceal his income from the IRS, by among other things, directing his patients to pay in cash or with personal checks that left the payee line blank and by paying his business and personal expenses with cash and third-party checks.
An indictment merely alleges that crimes have been committed. A defendant is presumed innocent until proven guilty beyond a reasonable doubt.If convicted, Kriemelmeyer faces a statutory maximum sentence of five years in prison for each of the tax evasion counts.

"Tax experts say there is nothing to be intimidated about"




Tax experts say there is nothing to be intimidated by when filing your taxes this year, despite some changes to tax laws that went into effect at the start of the new year.

One difference will be how your 1040 tax form will look. It will now be condensed to the size of a postcard. However, it will still have six pages of information you must fill out.
This year, there is also an increase to standard deductions. For married couples who file jointly, the deduction amount is now $24,000. For those who are single or married but filing separately, its $12,000.
"The Heritage Foundation estimated that 86 percent of people will now take the standard deduction. What that means is those people prior to the changes would get to deduct interest on their house, real estate taxes and state income taxes paid," says Kendall Roberts, a certified public accountant based out of Clive.
Roberts adds that new tax laws could impact those who work from home too. The reimbursed employee expenses section on the federal tax return was removed.
"That section was eliminated all together. That impacts a lot of people that had expenses associated with their company's work and now they can't deduct it," says Roberts.

Suffolk County Resident Pleads Guilty to Employment Tax Fraud – he should have hired Selig & Associates



A Suffolk County, New York, resident pleaded guilty today to failing to account for and pay over employment taxes to the Internal Revenue Service (IRS), announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division. 
According to court documents, Scott Warner owned and operated a temporary employment agency in Suffolk County, New York, that did business under multiple names, including Around the Clock Staffing Inc., Your Staffing Service Inc., Your Staffing Services Inc., Revlis Consulting Corp., and City Consulting Corp.  Warner was responsible for withholding federal income tax, Social Security and Medicare taxes from his employees’ wages, paying the taxes over to the IRS, and filing employment tax returns.  Despite this obligation, Warner failed to pay over to the IRS approximately $687,480 withheld from employee wages from Oct. 2012 through Dec. 2016. 
Warner faces a maximum sentence of five years in prison.  He also faces a period of supervised release, restitution, and monetary penalties.
