Jury Finds Another Dentist Guilty of Tax Evasion




Directed Patients to Pay in Cash

A federal jury convicted a dentist today of four counts of tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Scott C. Blader.
According to evidence presented at trial, Frederick G. Kriemelmeyer, 70, operated a dental practice In 2007, Kriemelmeyer was ordered by the U.S. District Court to pay $135,337 to the Internal Revenue Service (IRS) for unpaid income taxes. By 2012, the IRS had assessed Kriemelmeyer for more than $450,000 in taxes, interest, and penalties. Evidence presented at the trial showed Kriemelmeyer took a number of actions to evade paying the taxes he owed, from at least 2013 through 2015, Kriemelmeyer did not file tax returns reporting the income from his dental practice, directed his patients to pay him in cash or by check with blank payee lines, and paid his business and personal expenses with third-party checks and cash.
U.S. District Judge William M. Conley has set sentencing for May 19, 2020. At sentencing, Kriemelmeyer faces a statutory maximum sentence of five years in prison for each count of tax evasion. He also faces a period of supervised release, monetary penalties, and restitution.

IRS Enforcement Action Against Offshore Depositors (a/k/a “Cheaters”) Continues with a Vengeance



The IRS says people involved in offshore tax avoidance should come in voluntarily and face the music. (IR-2019-43) Hiding money or assets in unreported offshore accounts remains on the Internal Revenue Service’s “Dirty Dozen” list of tax scams for 2019, the agency said today. Compiled annually, the “Dirty Dozen” lists a variety of common scams that taxpayers may encounter anytime, including offshore schemes. Many of these peak during filing season as people prepare their tax returns or seek help with their taxes.Taxpayers should remain wary of offshore avoidance schemes. Following the IRS intensifying efforts on offshore issues in recent years, many taxpayers have already voluntarily disclosed their participation in these schemes. The IRS conducted thousands of offshore-related civil audits that resulted in the payment of tens of millions of dollars in unpaid taxes. The IRS has also pursued criminal charges leading to billions of dollars in criminal fines and restitution.“Offshore evasion remains a primary focal point of overall IRS enforcement efforts,” said IRS Commissioner Chuck Rettig. “Our Criminal Investigation and civil enforcement teams work closely with the Justice Department in the international arena to ensure our nation’s tax laws are followed. Taxpayers considering hiding funds or assets offshore should think twice; the civil penalties and criminal sanctions can be severe.” Illegal scams like these can lead to significant penalties as well as interest and possible criminal prosecution. The IRS Criminal Investigation Division works closely with the Department of Justice to shut down scams and prosecute the criminals behind them.
Hiding income offshore
Over the years, numerous individuals have been identified as evading U.S. taxes by attempting to hide income in offshore banks, brokerage accounts or nominee entities. They then access the funds using debit cards, credit cards or wire transfers. Others have used foreign trusts, employee-leasing schemes, private annuities or insurance plans for the same purpose. The IRS uses information gained from its investigations to pursue taxpayers with undeclared accounts, as well as bankers and others suspected of helping clients hide their assets overseas. While there are legitimate reasons for maintaining financial accounts abroad, there are reporting requirements that need to be fulfilled. U.S. taxpayers who maintain such accounts and who do not comply with reporting requirements are breaking the law and risk significant fines, as well as the possibility of criminal prosecution. The IRS reminds taxpayers who have failed to properly report their offshore investments or pay tax on these investments’ income, to come forward.  Since the circumstances of taxpayers vary widely, the IRS offers several options for addressing the noncompliance.

Third-party reporting  

Under the Foreign Account Tax Compliance Act (FATCA) and the network of intergovernmental agreements between the U.S. and partner jurisdictions, automatic third-party account reporting continues. The IRS receives more information regarding potential non-compliance by U.S. persons because of the Department of Justice’s Swiss Bank Program. This information makes it less likely that offshore financial accounts will go unnoticed by the IRS. Penalties for failure to properly report offshore transactions can be severe. A summary of these potential penalties as well as a comparison of what must be reported on Form 8938, Statement of Specified Foreign Financial Assets, and the Report of Foreign Bank and Financial Accounts (FBAR) can be found on IRS.gov.

Dentist Sentenced for Tax Evasion


George Fenzell of Douglas, was sentenced to 16 months in prison, one year of supervised release and ordered to pay $157,407 in restitution to the IRS. In November 2014, Fenzell pleaded guilty to tax evasion. Fenzell operated a dental office in Shrewsbury, Massachusetts and from 1999 through 2012, Fenzell engaged in conduct intended to obstruct the IRS. For the years 1999 through 2007, he failed to file timely federal income tax returns and concealed income that he earned from his dental practice from the IRS. Additionally, Fenzell failed to file his tax returns for 2008 through 2011. He concealed his dental business receipts by diverting the funds through nominee entities, including River Valley Dental. He used multiple nominee bank accounts to conceal his ownership of his income and assets. Fenzell also titled and registered a Lincoln Navigator and Ducati motorcycle with another nominee entity, Smiling Trust, and made extensive use of cash in order to conceal his fraud from the IRS.

Woman Sentenced for Food Stamp Fraud and Tax Evasion



Sherica Lacey Lee, of McCalla, was sentenced to 24 months in prison and ordered to forfeit $23,757 to the government as proceeds of illegal activity. She also was ordered to pay that same amount in restitution, plus interest, to the Department of Agriculture and to pay $134,448 in restitution, plus interest, to the IRS. Lee is currently serving a sentence for attempting to defraud the Gulf Coast oil spill fund. Lee pleaded guilty in August 2015 to tax evasion and wire fraud. Between July 2009 and June 2013, Lee received food stamp benefits she was not eligible to receive. In addition, Lee evaded income taxes for 2008 by preparing and submitting a personal tax return that falsely reported she had no taxable income, when she had $229,147 in taxable income. Lee also ran a tax preparation business, Lacey's Income Tax Service, with several locations in the Birmingham area. Between 2008 and 2010, Lee's company filed more than 2,000 tax returns and generated about $2.5 million in receipts.

IRS Wins PTIN Case, another great article by the Learned Tax Attorney Roger Russell



The Court of Appeals for the District of Columbia Circuit has given the IRS a victory in its quest to charge fees for issuing and renewing Preparer Tax Identification Numbers. The IRS was authorized by Congress in 1976 to require a tax preparer to list an identifying number on any returns they prepared, and specified that the number would be the preparer’s Social Security number. Although PTINs as a substitute for the preparer’s Social Security number have been around since 1999, they weren’t required to be used until 2010. That’s when the IRS began charging for them. And although the service’s attempt to regulate preparers was nullified by the D.C. Circuit Court in 2014, the court left intact the IRS’s ability to require and charge for PTINs.  A group of tax return preparers filed a class action lawsuit challenging the PTIN fee, Brittany Montrois, Class of More Than 700,000 Similarly Situated Individuals And Businesses, Et. Al., v. U.S.The IRS lost in the district court, which found the agency lacks statutory authority to charge the fee. On appeal, the circuit court reversed in favor of the IRS, concluding that it acted within its authority under the Independent Offices Appropriations Act in charging the fee. It further concluded that the IRS’s decision to charge the fee was not arbitrary and capricious. However, the circuit court remanded the case to the district court for further proceedings, “including an assessment of whether the amount of the PTIN fee unreasonably exceeds the costs to the IRS to issue and maintain PTINs.” The decision means that preparers won’t be getting any refunds of the fees they paid for PTINs, as the lower court ordered, since the circuit court vacated that part of the district court’s judgment.

"Tax experts say there is nothing to be intimidated about"




Tax experts say there is nothing to be intimidated by when filing your taxes this year, despite some changes to tax laws that went into effect at the start of the new year.

One difference will be how your 1040 tax form will look. It will now be condensed to the size of a postcard. However, it will still have six pages of information you must fill out.
This year, there is also an increase to standard deductions. For married couples who file jointly, the deduction amount is now $24,000. For those who are single or married but filing separately, its $12,000.
"The Heritage Foundation estimated that 86 percent of people will now take the standard deduction. What that means is those people prior to the changes would get to deduct interest on their house, real estate taxes and state income taxes paid," says Kendall Roberts, a certified public accountant based out of Clive.
Roberts adds that new tax laws could impact those who work from home too. The reimbursed employee expenses section on the federal tax return was removed.
"That section was eliminated all together. That impacts a lot of people that had expenses associated with their company's work and now they can't deduct it," says Roberts.
