President of Consulting Firm Pleads Guilty to Employment Tax Fraud (He should have hired SELIG & Associates)


Did Not Pay Over to the IRS Nearly $1 Million in Employment Taxes


On September 3, 2020 a businessman (who didn’t hire Selig & Associates) pleaded guilty to failing to collect, truthfully account for, and pay over employment taxes, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney G. Zachary Terwilliger for the Eastern District. According to documents and information provided to the court, the president and director of a technology consulting services firm in was responsible for collecting, truthfully accounting for, and paying over to the IRS Social Security, Medicare, and income taxes withheld from his employees’ wages. Beginning as early as 2007 and through 2015, he did not pay over more than $980,000 in employment taxes to the IRS. During this time, he entered into three separate installment agreements with the IRS committing to make the payments, but defaulted each time. U.S. District Judge David Novak scheduled the sentencing for Feb. 10, 2021. At sentencing, he faces a maximum sentence of five years in prison as well as a period of supervised release, restitution, and monetary penalties. Principal Deputy Assistant Attorney General Zuckerman and U.S. Attorney Terwilliger thanked special agents of IRS-Criminal Investigation, who conducted the investigation, and Assistant Chief Todd Ellinwood and Trial Attorney William Montague of the Tax Division and Assistant U.S. Attorney David McGuire, who are prosecuting the case.

Doctor Sentenced to Prison for Tax Evasion (he should have hired Selig & Associates)



He Tried to Thwart IRS Collection Efforts

On October 2nd 2019 another medical doctor was sentenced to 12 months and one day in prison for evading the payment of his income taxes, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and United States Attorney R. Andrew Murray. According to documents and information provided to the court, from May 2012 to December 2015, the good doctor took several actions to evade payment of federal income taxes, interest, and penalties he accrued over six previous tax years. The sawbones ignored a duly-issued Internal Revenue Service (IRS) summons to appear before an IRS collections officer with his pertinent financial records.  After the IRS sought and received a court order compelling him to comply with the summons, he provided minimal information and omitted records related to any financial accounts and assets he may have had. The doctor also hid his assets from the IRS by depositing his paychecks on a reloadable debit card and having wages issued in the name of a company he controlled rather than directly to himself.

In addition to the term of imprisonment, U.S. District Judge Conrad ordered the despondent doctor to serve one year of supervised release and to pay a $10,000 fine. Restitution will be ordered at a later date.

‘Here is the entry,’ resumed Dodson. ‘“Middlesex, Capias MARTHA BARDELL, WIDOW, v. SAMUEL PICKWICK. Damages #1500. Dodson & Fogg for the plaintiff, Aug. 28, 1827.” All regular, Sir; perfectly.’ Dodson coughed and looked at Fogg, who said ‘Perfectly,’ also. And then they both looked at Mr. Pickwick.
‘I am to understand, then,’ said Mr. Pickwick, ‘that it really is your intention to proceed with this action?’
‘Understand, sir!—that you certainly may,’ replied Dodson, with something as near a smile as his importance would allow.
‘And that the damages are actually laid at fifteen hundred pounds?’ said Mr. Pickwick.
‘To which understanding you may add my assurance, that if we could have prevailed upon our client, they would have been laid at treble the amount, sir,’ replied Dodson. ‘I believe Mrs. Bardell specially said, however,’ observed Fogg, glancing at Dodson, ‘that she would not compromise for a farthing less.’
‘Unquestionably,’ replied Dodson sternly. For the action was only just begun; and it wouldn’t have done to let Mr. Pickwick compromise it then, even if he had been so disposed.
‘As you offer no terms, sir,’ said Dodson, displaying a slip of parchment in his right hand, and affectionately pressing a paper copy of it, on Mr. Pickwick with his left, ‘I had better serve you with a copy of this writ, sir. Here is the original, sir.’
‘Very well, gentlemen, very well,’ said Mr. Pickwick, rising in person and wrath at the same time; ‘you shall hear from my solicitor, gentlemen.’

‘And before I go, gentlemen,’ said the excited Mr. Pickwick, turning round on the landing, ‘permit me to say, that of all the disgraceful and rascally proceedings—’
‘Stay, sir, stay,’ interposed Dodson, with great politeness. ‘Mr. Jackson! Mr. Wicks!’
‘Sir,’ said the two clerks, appearing at the bottom of the stairs.
‘I merely want you to hear what this gentleman says,’ replied Dodson. ‘Pray, go on, sir—disgraceful and rascally proceedings, I think you said?’

‘You had better come up a step or two higher, if you can’t,’ added Mr. Fogg. ‘Go on, Sir; do go on. You had better call us thieves, Sir; or perhaps You would like to assault one Of us. Pray do it, Sir, if you would; we will not make the smallest resistance. Pray do it, Sir.’
As Fogg put himself very temptingly within the reach of Mr. Pickwick’s clenched fist, there is little doubt that that gentleman would have complied with his earnest entreaty, but for the interposition of Sam, who, hearing the dispute, emerged from the office, mounted the stairs, and seized his master by the arm.
‘You just come away,’ said Mr. Weller. ‘Battledore and shuttlecock’s a wery good game, vhen you ain’t the shuttlecock and two lawyers the battledores, in which case it gets too excitin’ to be pleasant. Come avay, Sir. If you want to ease your mind by blowing up somebody, come out into the court and blow up me; but it’s rayther too expensive work to be carried on here.’
And without the slightest ceremony, Mr. Weller hauled his master down the stairs, and down the court, and having safely deposited him in Cornhill, fell behind, prepared to follow whithersoever he should lead.
Mr. Pickwick walked on abstractedly, crossed opposite the Mansion House, and bent his steps up Cheapside. Sam began to wonder where they were going, when his master turned round, and said—
‘Sam, I will go immediately to Mr. Perker’s.’
‘That’s just exactly the wery place vere you ought to have gone last night, Sir,’ replied Mr. Weller.
‘I think it is, Sam,’ said Mr. Pickwick. ‘I knowit is,’ said Mr. Weller.
‘Well, well, Sam,’ replied Mr. Pickwick, ‘we will go there at once; but first, as I have been rather ruffled, I should like a glass of brandy–and–water warm, Sam. Where can I have it, Sam?’

Married Couple Sentenced and Sent to Slammer (Failure to Pay Income Tax is Serious)


A not-so-happy husband and wife were sentenced to 36 and 12 months respectively for violating federal tax laws (not paying income taxes). The lamentable lovebirds were also ordered to pay restitution in the amounts of $1,969,463 and $1,937,267 respectively, which represents unpaid IRS taxes and every penalty the IRS could apply. After that, criminal fines of $250,000 and $100,000 were imposed on the disillusioned duo respectively. And after they were beaten down, broken and bankrupted, both battered defendants wearily agreed to the imposition of a fraud assessment (an additional $3 million dollars). The crestfallen couple has already paid more than $4 million in back taxes and interest (and that still isn’t enough for the IRS).

Liquor Smuggler Forfeits Booze & Vehicle After Guilty Plea (Tax Problems? Better call SELIG & Associates)




The New York State Department of Taxation and Finance and the Westchester County District Attorney’s Office announced Juncheng Chen of 136-18 64th Road, Flushing, Queens, pleaded guilty to attempting to smuggle untaxed liquor into New York State for resale. As part of his plea, Chen agreed to forfeit his vehicle, a Chevrolet Suburban SUV, and the alcohol seized when he was arrested. “Those who smuggle untaxed liquor are profiting at the expense of their neighbors and depriving local communities of critical funding for public programs and services,” said New York State Commissioner of Taxation and Finance Michael Schmidt. “We’ll continue to work with all levels of law enforcement to ensure those responsible are held accountable.” Chen will pay nearly $1,300 in tax as restitution as well. He faces additional monetary fines for penalty and interest when he’s sentenced on September 3 in Rye City Court. The case was prosecuted by Assistant District Attorney Nicole Gamble of the Westchester County District Attorney’s Office Economic Crimes Bureau. “We are committed to stopping any criminal who attempts to defraud the system and therefore steal from the people of New York State,” said Westchester County District Attorney Anthony A. Scarpino, Jr. “We will continue to work closely with Commissioner Schmidt and his investigators at the NY State Department of Taxation and Finance to prosecute crimes that affect all of us.” Chen was arrested by investigators with the Tax Department’s Criminal Investigations Division in December 2017 after his vehicle was stopped by New York State Police in Rye, NY. The vehicle was packed with more than 700 liters of liquor, which he purchased at multiple liquor outlets in New Hampshire.

IRS sends letters to virtual currency owners "pay back taxes and file amended returns" criminal prosecution imminent – better call SELIG & Associates


The Internal Revenue Service has begun sending letters to taxpayers with virtual currency transactions that potentially failed to report income and pay the resulting tax from virtual currency transactions or did not report their transactions properly. "Taxpayers should take these letters very seriously by reviewing their tax filings and when appropriate, amend past returns and pay back taxes, interest and penalties," said IRS Commissioner Chuck Rettig. "The IRS is expanding our efforts involving virtual currency, including increased use of data analytics. We are focused on enforcing the law and helping taxpayers fully understand and meet their obligations." The IRS started sending the “educational letters” to taxpayers last week. By the end of August, more than 10,000 taxpayers will receive these letters. The names of these taxpayers were obtained through various ongoing IRS compliance efforts. For taxpayers receiving an educational letter, there are three variations: Letter 6173, Letter 6174 or Letter 6174-A, all three versions strive to help taxpayers understand their tax and filing obligations and how to correct past errors. Taxpayers are pointed to appropriate information on IRS.gov, including which forms and schedules to use and where to send them. Last year the IRS announced a Virtual Currency Compliance campaign to address tax noncompliance related to the use of virtual currency through outreach and examinations of taxpayers. The IRS will remain actively engaged in addressing non-compliance related to virtual currency transactions through a variety of efforts, ranging from taxpayer education to audits to criminal investigations. Virtual currency is an ongoing focus area for IRS Criminal Investigation. IRS Notice 2014-21 (PDF) states that virtual currency is property for federal tax purposes and provides guidance on how general federal tax principles apply to virtual currency transactions. Compliance efforts follow these general tax principles. The IRS will continue to consider and solicit taxpayer and practitioner feedback in education efforts and future guidance. The IRS anticipates issuing additional legal guidance in this area in the near future. Taxpayers who do not properly report the income tax consequences of virtual currency transactions are, when appropriate, liable for tax, penalties and interest. In some cases, taxpayers could be subject to criminal prosecution.

Helping Undocumented Immigrants and Understanding the Causes of Identity Theft


Up until recently, identity theft was as popular as it was pervasive. And notwithstanding a small smattering of high profile cases, identity thieves went largely unpunished. 

But what exactly is identity theft? In a nutshell, identity theft occurs when one person intentionally misappropriates another person’s name and Social Security number to commit fraud and crime. 

Since I am a Federal Tax Practitioner I will discuss the two types of identity thieves that our Office most frequently encounters. The first identity thief steals someone’s name and Social Security number so she can file a phony tax return and pocket a refund. This particular crime is commonly referred to as “refund theft”. The second identity thief a/k/a (criminal "Number Two") commits what is colloquially called “employment theft”.  The perpetrators, who are usually in the country illegally, steal someone’s Social Security number, or alternatively, knowingly purchase a  stolen Social Security number ostensibly so they can work.

Unfortunately, a goodly percentage of these so-called "Employment Thieves" are also common criminals who aggressively leverage their purloined identities to obtain entitlements, benefits and merchandise that they’re not entitled to. The costs associated with “employment theft” exceed One Hundred Billion Dollars a year. 

And that’s all there is to understanding identity theft. Nothing fancy, nothing elaborate, just a parasitic self-serving crime committed by a cold-blooded coterie of parasitic self-serving criminals. 

In 2011 David Selig publicly exposed the astronomical amount of earned income fraud that illegal immigrants were committing under IRC Section 152. Queens Businessman Admits Stealing $251000 in Sales Taxes

The New York State Department of Taxation and Finance announced guilty pleas to criminal tax fraud and grand larceny charges by a business owner and his two Queens businesses. Between March 1, 2009, and February 28, 2018, Pyong Chon Yim, 56, and his businesses, Advance Auto Sport Corp. and Advance Motor Sport Inc., located at 35-50 College Point Boulevard, College Point, NY, failed to remit nearly $251,000 in sales tax collected from customers. “Profiting off the backs of honest neighbors is not only bad business, it’s criminal,” said New York State Executive Deputy Commissioner of Taxation and Finance Andrew Morris. “This illegal activity robs local communities of critical funding for public programs and services New Yorkers rely on. We’ll continue to work with all levels of law enforcement, including the Queens District Attorney’s Office, to ensure those committing tax fraud are held accountable.” Acting Queens District Attorney John M. Ryan said, “The defendant collected tax dollars and then pocketed the cash. This is wholly unacceptable and not only cheats the local government, but also every other honest taxpayer. The defendant has admitted his guilt and will make full restitution. I want to commend the New York State Department of Taxation and Finance for their work in this case. We will continue to collaborate with our law enforcement partners to prosecute those who knowingly commit tax fraud.”

Man Sentenced for Filing Hundreds of False Documents with IRS



On May 12 Scott Bodley was sentenced to 78 months in prison. Bodley was convicted on Feb. 6 for filing false money orders with the IRS, filing false 1099-OID documents, filing false tax returns, income tax evasion, and endeavoring to impede and obstruct the due administration of the Internal Revenue laws. Bodley stopped filing legitimate tax returns in 1999. In 2003, he threatened to file liens on an IRS agent who was auditing his 1999-2001 taxes. From 2004 to 2009, Bodley filed false W-4 documents with his employers in an effort to avoid the withholding of taxes from his paychecks. In 2004, he quit his job in an effort to stop an IRS levy on his wages. In 2008, Bodley filed in excess of 100 false forms with the IRS in an attempt to harass and impede IRS agents in the performance of their duties.
