Insurance Salesman Sentenced To Prison For Tax Fraud (He should have hired SELIG & Associates)



A Newington, Connecticut, insurance salesman was sentenced to 70 months in prison for tax fraud, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division.   

Terry DiMartino was convicted after a jury trial in March 2016 of one count of corruptly interfering with the due administration of the internal revenue laws, two counts of filing false tax returns and five counts of willfully failing to file tax returns.  DiMartino was an insurance salesman for numerous insurance companies located in Connecticut and elsewhere.  Despite earning millions of dollars in insurance commissions over the last decade, DiMartino did not file accurate tax returns or pay the taxes owed.

According to the evidence presented at trial, DiMartino attempted to obstruct the IRS by mailing false documents to the IRS, including three false tax returns for the 2007 tax year, one of which requested a fraudulent $14 million refund.  He sent false and threatening correspondence to the IRS in an attempt to defeat the IRS’s assessment, collection and investigative efforts.  He submitted false and threatening correspondence to insurance companies that sought to cooperate with the IRS collection activities.  DiMartino also set up nominee entities that he used to divert his insurance commissions.  He used the nominees to hide and conceal assets to prevent the IRS from collecting on his tax liabilities.  DiMartino has not filed an accurate individual income tax return since the 1996 tax year.

In addition to the term of imprisonment, U.S. District Court Judge Alvin W. Thompson ordered DiMartino to serve one year of supervised release and to pay $658,547.62 in restitution to the IRS.

Principal Deputy Assistant Attorney General Zuckerman commended special agents of IRS-Criminal Investigation, who investigated the case, and Tax Division Trial Attorney Jason M. Scheff and former Tax Division Trial Attorney Erin B. Pulice, who prosecuted the case.  The Tax Division expressed gratitude to the U.S. Attorney’s Office for the District of Connecticut for their assistance in the investigation and prosecution of this case.

Doctor sentenced to 6 months, ordered to pay $105,673 failed to pay over Social Security, Medicare & Employment Taxes

Dr. Nicholas Garritano, 55, has been sentenced to six months in jail and ordered to pay $105,673 after failing to pay over Social Security, Medicare and employment taxes collected from his employees.
During 11 quarters spanning 2009 through 2012, Garritano was president and sole shareholder of the corporation Dr. N.M. Garritano Inc., and was responsible for the corporation’s business and financial operations. He caused the corporation to pay taxable wages and salaries to its employees, from which federal income and FICA taxes were withheld, according to court documents.
Garritano, who previously pleaded guilty in the case, filed quarterly federal forms on behalf of the corporation relating to the employment taxes. Although the corporation withheld substantial employment taxes from the wages of its employees for each quarter, he failed to pay over the full amount of the withheld taxes to the IRS, according to court documents.

Chiropractor Sentenced For Tax Evasion (he should have hired SELIG & Associates)




On April 19, 2017, in Minneapolis, Minnesota, Donald Gibson was sentenced to 33 months in prison for tax evasion and for presenting a fake financial instrument to the U.S. Department of Treasury. Gibson failed to file his 2004 through 2014 individual income tax returns and attempted to evade his income tax liabilities for these years by diverting money to a warehouse bank called MYICIS, cashing over $800,000 in business checks at a check-cashing facility and submitting fake money orders and bogus financial instruments to the IRS. Gibson also formed Sovereign Christian Mission (SCM), a purported religious organization, as a way to further hide his chiropractic income and pay for his personal expenses. Gibson used SCM to pay for his groceries, entertainment, dinners, and car repairs. While the IRS was auditing his tax returns and later during the criminal investigation, Gibson presented a fake financial instrument purporting to be worth $300 million to the IRS and claimed that it paid off his income tax liabilities.
