Another Dentist Indicted for Tax Evasion

A Federal grand jury indicted another dentist for tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Scott C. Blader.
According to the indictment, Frederick G. Kriemelmeyer, 70, operated a dental practice  In 2007, Kriemelmeyer was ordered by the U.S. District Court to pay $135,337 to the Internal Revenue Service (IRS) for unpaid individual income taxes.  By December 2012, the IRS had assessed Kriemelmeyer more than $450,000 in taxes, interest and penalties.  Beginning in approximately 2011, Kriemelmeyer allegedly took a number of actions to evade payment of this assessment. The indictment also charges that for the years 2013 through 2015 Kriemelmeyer failed to file tax returns and attempted to evade the taxes due on income from his dental practice. Kriemelmeyer allegedly sought to conceal his income from the IRS, by among other things, directing his patients to pay in cash or with personal checks that left the payee line blank and by paying his business and personal expenses with cash and third-party checks.
An indictment merely alleges that crimes have been committed. A defendant is presumed innocent until proven guilty beyond a reasonable doubt. If convicted, Kriemelmeyer faces a statutory maximum sentence of five years in prison for each of the tax evasion counts.

Man Pleads Guilty to Payroll Tax Fraud Failed to Pay IRS $1 Million in Employment Taxes & Employee Withholdings

A computer software development company owner pleaded guilty today to failing to account for and pay over employment taxes withheld from his employees’ wages announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney R. Trent Shores for the Northern District of Oklahoma.
According to documents and information provided to the Court, as the owner and operator of Tulsa-based Zealcon Corporation, Earenest J. Grayson Jr. was responsible for withholding, accounting for and paying over to the Internal Revenue Service (IRS) payroll taxes and withholdings due on the wages paid to Zealcon employees. For the period, January 2014 through June of 2016, Grayson intentionally caused a total tax loss of more than $1 million by intentionally not paying to the IRS income and social security taxes withheld from Zealcon employees’ wages and social security taxes due from Zealcon on those wages.
“Failing to account for or pay payroll taxes is not acceptable,” said Principal Deputy Assistant Attorney General Zuckerman of the Justice Department’s Tax Division. “The Department of Justice, working with the IRS, will ensure that our tax system is fairly enforced throughout the country.”
“Earenest Grayson is a dishonest employer who cheated both his employees and the United States government of more than $1,000,000 in stolen payroll taxes. Some of those taxes were payments for the Social Security and Medicare coverage of the employees,” said U.S. Attorney Trent Shores. “I hope Mr. Grayson’s potential prison sentence will dissuade other business owners from trying to cheat the system. Millions of honest small businesses pay their fair share of taxes to finance government operations as well as Social Security and Medicare for the elderly. Unfortunately, Mr. Grayson’s choice not to do so has subjected him to criminal penalties.”
United States District Court Judge Claire V. Eagan scheduled Grayson’s sentencing for Oct. 3, 2019.

He's Gone - Investigators Seize More than 200 Cartons of Untaxed Cigarettes Shipped Through Mail

The New York State Department of Taxation and Finance, United States Department of Homeland Security – Homeland Security Investigations – New York (HSI-NY), and the Nassau County District Attorney’s Office today announced felony tax charges against a Bayside man.
Jeong Min Park, 41, of 61-27 224th Street, Bayside, NY, is accused of attempting to evade the cigarette tax and possessing more than 200 cartons of illegal cigarettes that had been shipped through the U.S. Postal Service to a nail salon located at 2 Rockaway Avenue, Valley Stream, NY.

Investigators witnessed Park loading the packages into a vehicle and driving away. A mobile surveillance team then followed Park until Nassau County District Attorney investigators pulled him over. After securing a search warrant for the vehicle, investigators found 208 cartons of untaxed cigarettes.

U.S. Postal inspectors also coordinated with investigators from the Tax Department’s Cigarette Strike Force, HSI-NY, and Nassau County District Attorney’s Office.

“Attempts to sidestep cigarette taxes put honest business owners at a competitive disadvantage, tilting the balance in favor of those willing to break the law,” said New York State Executive Deputy Commissioner of Taxation and Finance Andrew Morris. “We’ll continue to work with all levels of law enforcement, including our partners on the national and local levels, to ensure these crimes don’t go unpunished.”

“This is not only illegally selling of cigarettes untaxed to make a larger profit, but they misrepresented the goods on the manifest in order to smuggle it into the U.S.,” said Angel M. Melendez, Special Agent in Charge of HSI-NY. “We continue to leverage our partnerships with other law enforcement agencies to investigate tax and customs fraud cases.”

“Through the collaborative efforts of law enforcement, the defendants scheme went up in smoke,” said Postal Inspector in Charge Philip R. Bartlett. “This arrest sends a strong message that law enforcement is always watching for those who cheat the system through the distribution of illegal cigarettes and contraband. We thank our law enforcement partners for their dedication in keeping the U. S. Mail and our employees safe.”

“Selling and possessing untaxed cigarettes cheats not only the state and city out of much-needed tax revenue, but also hurts law-abiding businesses,” said Nassau County District Attorney Madeline Singas. “Due to the combined efforts of NCDA investigators, the New York State Department of Taxation and Finance, the Department of Homeland Security and Postal Service inspectors, we’ve helped level the playing field for honest business owners and stopped an alleged tax cheat.”

A criminal complaint is only an accusation; the defendant is presumed innocent until proven guilty.

IRS explains CP2000 notices sent to taxpayers when their tax return doesn’t match information from 3rd parties

When a tax return’s information doesn’t match data reported to the Internal Revenue Service by employers, banks and other third parties, the IRS will send a letter to the taxpayer. The letter is called an IRS Notice CP2000, and it gives detailed information about issues the IRS identified and provides steps taxpayers should take to resolve those issues. This isn’t a formal audit notification, but a notice to see if the taxpayer agrees or disagrees with the proposed tax changes. Taxpayers should respond to the CP2000, usually within 30 days from the date printed on the notice. If a timely response can’t be made, taxpayers need to call the toll-free number shown on the notice and request additional time to respond. Taxpayers can also call the number on the notice for additional information or assistance, or visit Understanding Your CP2000 Notice on IRS.gov. The IRS will send another notice if the taxpayer doesn’t respond to the initial one, or if the IRS can’t accept the additional information provided. That follow-up notice is called an IRS Notice CP3219A, Statutory Notice of Deficiency. This notice gives detailed information about why the IRS proposes a tax change and how the agency determined the change. The notice tells taxpayers about their right to challenge the decision in Tax Court. Even if they decide not to go to court, the IRS will continue to work with them during the statutory notice timeframe to help resolve the issue. For more information, check out Understanding your CP3219A Notice on IRS.gov.
