A man pleaded guilty to tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney Jay E. Town. According to court documents and statements made in court, in 2011, John P. Cooney, 70, filed delinquent tax returns for 2008 through 2010, in which admitted that he owed the Internal Revenue Service (IRS) approximately $780,000, but did not include any payment. Rather, to evade his tax obligation, Cooney created a nominee entity, GVA Advisors, LLC (GVA), and directed that income from his employer and dividends from his investments be paid to an account in GVA’s name, rather than to him directly. From 2013 through 2016, Cooney deposited more than $435,000 into the GVA account, concealing the funds from the IRS. In all, as result of his actions, Cooney owed by 2017 more than $1.3 million in outstanding balances, penalties, and interest to the IRS. Sentencing is scheduled for May 28, 2020. At sentencing, Cooney faces a statutory maximum sentence of five years in prison. He also faces a period of supervised release and monetary penalties. Pursuant to the plea agreement, Cooney has agreed to pay restitution of $1,311,904 to the United States.

The New York State Department of Taxation and Finance, United States Department of Homeland Security – Homeland Security Investigations – New York (HSI-NY), and the Nassau County District Attorney’s Office today announced felony tax charges against a Bayside man.
Jeong Min Park, 41, of 61-27 224th Street, Bayside, NY, is accused of attempting to evade the cigarette tax and possessing more than 200 cartons of illegal cigarettes that had been shipped through the U.S. Postal Service to a nail salon located at 2 Rockaway Avenue, Valley Stream, NY.
Investigators witnessed Park loading the packages into a vehicle and driving away. A mobile surveillance team then followed Park until Nassau County District Attorney investigators pulled him over. After securing a search warrant for the vehicle, investigators found 208 cartons of untaxed cigarettes.
U.S. Postal inspectors also coordinated with investigators from the Tax Department’s Cigarette Strike Force, HSI-NY, and Nassau County District Attorney’s Office.
“Attempts to sidestep cigarette taxes put honest business owners at a competitive disadvantage, tilting the balance in favor of those willing to break the law,” said New York State Executive Deputy Commissioner of Taxation and Finance Andrew Morris. “We’ll continue to work with all levels of law enforcement, including our partners on the national and local levels, to ensure these crimes don’t go unpunished.”
“This is not only illegally selling of cigarettes untaxed to make a larger profit, but they misrepresented the goods on the manifest in order to smuggle it into the U.S.,” said Angel M. Melendez, Special Agent in Charge of HSI-NY. “We continue to leverage our partnerships with other law enforcement agencies to investigate tax and customs fraud cases.”
“Through the collaborative efforts of law enforcement, the defendants scheme went up in smoke,” said Postal Inspector in Charge Philip R. Bartlett. “This arrest sends a strong message that law enforcement is always watching for those who cheat the system through the distribution of illegal cigarettes and contraband. We thank our law enforcement partners for their dedication in keeping the U. S. Mail and our employees safe.”
“Selling and possessing untaxed cigarettes cheats not only the state and city out of much-needed tax revenue, but also hurts law-abiding businesses,” said Nassau County District Attorney Madeline Singas. “Due to the combined efforts of NCDA investigators, the New York State Department of Taxation and Finance, the Department of Homeland Security and Postal Service inspectors, we’ve helped level the playing field for honest business owners and stopped an alleged tax cheat.”
A criminal complaint is only an accusation; the defendant is presumed innocent until proven guilty.

The New York State Department of Taxation and Finance announced guilty pleas to criminal tax fraud and grand larceny charges by a business owner and his two Queens businesses. Between March 1, 2009, and February 28, 2018, Pyong Chon Yim, 56, and his businesses, Advance Auto Sport Corp. and Advance Motor Sport Inc., located at 35-50 College Point Boulevard, College Point, NY, failed to remit nearly $251,000 in sales tax collected from customers. “Profiting off the backs of honest neighbors is not only bad business, it’s criminal,” said New York State Executive Deputy Commissioner of Taxation and Finance Andrew Morris. “This illegal activity robs local communities of critical funding for public programs and services New Yorkers rely on. We’ll continue to work with all levels of law enforcement, including the Queens District Attorney’s Office, to ensure those committing tax fraud are held accountable.” Acting Queens District Attorney John M. Ryan said, “The defendant collected tax dollars and then pocketed the cash. This is wholly unacceptable and not only cheats the local government, but also every other honest taxpayer. The defendant has admitted his guilt and will make full restitution. I want to commend the New York State Department of Taxation and Finance for their work in this case. We will continue to collaborate with our law enforcement partners to prosecute those who knowingly commit tax fraud.”
A medical doctor pleaded guilty to corruptly obstructing the due administration of the internal revenue laws yesterday, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and United States Attorney for the Middle District of North Carolina Matthew G.T. Martin.
According to court documents, Dr. Joseph Jacob Hummel purchased the home of an acquaintance, only to be repaid for the purchase a short time later. When Special Agents with Internal Revenue Service-Criminal Investigation (IRS) interviewed Dr. Hummel about this real estate transaction, he falsely stated that he rented the property to the original owner and then sent the agents a sham lease, supporting this statement.
Hummel faces a maximum sentence of three years in prison. He also faces a period of supervised release and monetary penalties. Sentencing is scheduled for March 26, 2019.

Bronx Tax Preparer Created False Tax Returns for Orange County ResidentsWithout their Knowledge Orange County District Attorney David M. Hoovler announced today that on Thursday, April 11, 2019, Michael G. Magnaldi, 54, of Pelham, a paid tax preparer, and the owner of MGM Tax Solutions, located at 1978 Williamsburg Road, Bronx, New York, was arrested and charged with multiple felonies related to the filing of eight sets false tax returns for Orange County residents. Magnaldi was arraigned before Town of New Windsor Justice Noreen Calderin on felony charges of Grand Larceny in the Third Degree, Criminal Tax Fraud in the Fourth Degree, and eight counts of Offering a False Instrument for Filing in the First Degree. Felony complaints filed in the action allege that in 2016, and 2017, Magnaldi created New York State Personal Income Tax Returns containing false information for a number of Orange County residents who were clients of his tax preparation business. The false information, which is alleged to have been placed on the returns without the knowledge of the clients, made it appear that Magnaldi’s clients were entitled to greater tax refunds than they should have received. As a result, $6,091 in refunds were improperly sent to these clients. Under New York State law, paid tax preparers must register with the New York State Department of Taxation and Finance, sign the returns they prepare and file them electronically. It is alleged that Magnaldi had his clients mail the fraudulent tax returns directly to the New York State Department of Taxation and Finance and failed to indicate on the tax returns that he prepared them as required. The charges were the result of an investigation conducted by the New York State Department of Taxation and Finance’s Criminal Investigations Unit. Magnaldi was arrested on April 11, 2019, by Criminal Investigators of the New York State Department of Taxation and Finance’s Criminal Investigations Division. Magnaldi is next scheduled to appear in court on June 13, 2019.
The case is being prosecuted by Chief Assistant District Attorney Christopher Borek.
District Attorney Hoovler thanked the New York State Department of Taxation and Finance for their investigation and referral of the case.
“No one likes to pay taxes, but those who go to professional tax preparers have the right to know that their tax returns are being prepared properly and without fraud,” said District Attorney Hoovler. “My office is prepared to prosecute anyone who uses unsuspecting Orange County residents to engage in fraud, regardless of where they live or work. This case is only one example of the close working relationship which my office has developed with the Criminal Investigations Division of the New York State Tax Department. I am grateful that this close coordination has resulted in Orange County regularly having among the largest returns on investment of any county in New York State under the Crimes Against Revenue Program [CARP] Program.”
“We’ll continue to crackdown on criminal ‘ghost preparers’—those paid preparers who fail to sign their clients’ returns, register, e-file, or comply with other requirements intended to protect taxpayers from unethical tax preparers,” said John Harford, who leads the NYS Tax Department’s Criminal Investigations Division. “I commend our fantastic investigators and auditors and thank the Orange County District Attorney for prosecuting this case.”
A criminal charge is merely an allegation that a defendant has committed a violation of the criminal law, and it is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the State’s burden to prove guilt beyond a reasonable doubt.

The Court of Appeals for the District of Columbia Circuit has given the IRS a victory in its quest to charge fees for issuing and renewing Preparer Tax Identification Numbers. The IRS was authorized by Congress in 1976 to require a tax preparer to list an identifying number on any returns they prepared, and specified that the number would be the preparer’s Social Security number. Although PTINs as a substitute for the preparer’s Social Security number have been around since 1999, they weren’t required to be used until 2010. That’s when the IRS began charging for them. And although the service’s attempt to regulate preparers was nullified by the D.C. Circuit Court in 2014, the court left intact the IRS’s ability to require and charge for PTINs. A group of tax return preparers filed a class action lawsuit challenging the PTIN fee, Brittany Montrois, Class of More Than 700,000 Similarly Situated Individuals And Businesses, Et. Al., v. U.S.The IRS lost in the district court, which found the agency lacks statutory authority to charge the fee. On appeal, the circuit court reversed in favor of the IRS, concluding that it acted within its authority under the Independent Offices Appropriations Act in charging the fee. It further concluded that the IRS’s decision to charge the fee was not arbitrary and capricious. However, the circuit court remanded the case to the district court for further proceedings, “including an assessment of whether the amount of the PTIN fee unreasonably exceeds the costs to the IRS to issue and maintain PTINs.” The decision means that preparers won’t be getting any refunds of the fees they paid for PTINs, as the lower court ordered, since the circuit court vacated that part of the district court’s judgment.

Queens District Attorney Richard A. Brown, joined by New York State Department of Taxation and Finance Commissioner Thomas H. Mattox, announced that on THURSDAY, JANUARY 8, 2015 a Queens man who owns an Edible Arrangements franchise in Springfield Gardens, Queens, has pleaded guilty to violations of the New York State Tax Code for failing to pay more than $185,000 in taxes due to both New York City and New York State.
District Attorney Brown said, “Sales taxes are meant for the public treasury - not to line the pockets of businessmen. The defendant showed a callous disregard for the tax laws. He stole from his customers as well as from the State of New York and the City by under reporting his business’ earnings. The defendant has now admitted his guilt and will be sentenced accordingly.”
Commissioner Mattox said, “The defendant admitted to willfully stealing tax dollars paid by customers, a crime that can’t be tolerated. We will continue to work with District Attorney Brown and other law enforcement partners to prosecute those who attempt to evade paying their fair share of taxes.”
District Attorney Brown identified the defendant as Maurice Letman, 42, of Springfield Gardens, Queens. The defendant is the owner of MSM Arrangements that operates as an Edible Arrangements franchise at 133-23 Springfield Boulevard in Queens. The business sells fruit baskets and fruit bouquets. Letman pleaded guilty to violations of sections 1804 and 1802 of the New York State Tax Code and corporate defendant MSM Arrangements pleaded guilty to a violation of section 1804 of the Tax Code and criminal tax fraud in the third degree before Acting Queens Supreme Court Justice Suzanne Melendez. The business will receive a conditional discharge. Defendant Letman will be sentenced on March 2, 2015.
District Attorney Brown said that the defendant’s business collected in excess of $2 million between 2007 and 2011, but failed to pay more than $100,000 in taxes owed. Between 2011 and 2013, the defendant’s business collected just over $1.2 million yet the defendant claimed in required filings to have only taken in about $26,000 - cheating the city and state coffers of another $50,000.
The District Attorney said that the defendant has repaid over $90,000 and must still pay another $97,537. The total restitution is $188,448. As a condition of the plea agreement, the defendant signed an agreement with the New York State Department of Taxation to pay penalties and interest in excess of $200,000.
The investigation was conducted by Forensic Tax Auditor Harry Marc-Charles of the New York State Department of Taxation and Finance under the supervision of Chunyip Tsui, the section head of Criminal Investigations Division.

The New York State Department of Taxation and Finance suspended the registration required for a Putnam County gas station to sell tobacco products after agents with the department’s Criminal Investigations Division discovered 21 cartons of contraband cigarettes.
The illegal cigarettes, bearing two different counterfeit New York State tax stamps, were seized after a routine cigarette inspection at the Citgo Mart, Inc., 1481 Route 22, in Brewster.
The store’s owner, Mohamed Aljahim, 36, of 45 Decan Smith Hill Road, Patterson, was charged with one felony and one misdemeanor. The defendant is scheduled to appear in court later this month.
“The charges in this case serve as a reminder to all shop owners across the state that selling untaxed cigarettes, no matter how large or small the quantity, is a serious crime that won’t be tolerated,” said Acting Commissioner Nonie Manion. “We will continue to work with prosecutors and all levels of law enforcement as we pursue these cases.” All cigarettes for retail sale in New York State must be purchased by a licensed distributor, and retail dealers must be in possession of purchase invoices showing that the taxes on the cigarettes have been paid. Those found in possession of untaxed cigarettes can face fines of up to $600 per carton as well as a prison sentence.
A criminal complaint is only an accusation; the defendant is presumed innocent until proven guilty. The case will be prosecuted by the Putnam County District Attorney’s Office.
