The IRS’s Heavy Hand Just Got Heavier

The Internal Revenue Service announced that James Lee will become the new chief of IRS Criminal Investigation (CI) on October 1 2020. Lee, currently CI's deputy chief and a 25-year veteran of the organization, will succeed current Chief Don Fort, who announced last month he will retire on September 30 2020. "Jim brings a quarter-century of Criminal Investigation management and field experience into this key enforcement role," said IRS Commissioner Chuck Rettig. "Jim is highly respected throughout the IRS and will continue long-standing working relationships with the civil enforcement functions of the IRS as well as with the Department of Justice's Tax Division and tax prosecutors throughout the country. He understands the need to support compliant taxpayers by maintaining a strong, robust enforcement effort focused on those who are compliance challenged." As Chief, CI, Lee will lead the IRS's criminal enforcement efforts to investigate tax code violations and other related financial crimes such as money laundering, public corruption, cybercrimes, identity theft, narcotics and terrorist-financing. Prior to serving as Deputy Chief of CI, he served as the Director of Field Operations, Northern Area where he oversaw CI enforcement programs in the Boston, New Jersey, New York, Ohio and Philadelphia Field Offices. He also previously served in executive roles as the Director of Field Operations, Southern Area and the Director, Strategy. Lee began his IRS CI career in 1995 as a special agent in Detroit. He moved into the CI leadership ranks and has held positions of increasing responsibility throughout his career including Supervisory Special Agent in the New Orleans Field Office; Headquarters Senior Analyst in the International and Financial Crimes Sections; Assistant Special Agent in Charge within the Boston Field Office; and Special Agent in Charge of the New Orleans Field Office and later the Chicago Field Office.

Owner of Long Island Painting Company Sentenced to Prison for Tax Evasion

Evaded Over $1 Million in Income and Employment Taxes A Long Island, New York, business owner was sentenced to 12 months and one day in prison today for tax evasion, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division.According to documents filed in this case and statements made in court, Warren J. Krotz, 62, of Huntington, New York, owned and operated W. Krotz Enterprises Inc. (WKEI), a professional painting business that provided services throughout Long Island. From 2010 through 2016, Krotz evaded both his individual income and employment tax liabilities. During this time, Krotz cashed approximately $6 million in checks at several check-cashing facilities. These checks were gross receipts of WKEI, but Krotz did not report the amounts on WKEI’s corporate income tax returns. Krotz also paid approximately $2 million in cash wages to employees, and did not withhold and pay over to the Internal Revenue Service (IRS) approximately $300,000 in employment taxes that were due.Additionally, Krotz admitted to receiving approximately $3 million in income that he did not report on his personal tax returns. In total, Krotz admitted to causing a tax loss to the IRS of approximately one million dollars. In addition to the prison term, U.S. District Judge Denis R. Hurley sentenced Krotz to serve three years of supervised release and to pay restitution of $1,031,633 to the IRS.Principal Deputy Assistant Attorney General Zuckerman commended special agents of IRS-Criminal Investigation, who investigated the case, and Trial Attorneys Jessica Moran and Kathryn Sparks of the Tax Division, who are prosecuting this case.

Owner of Company Sent to Prison for Employment Tax Fraud

In a nutshell, the Disgruntled defendant withheld taxes from his employees and kept it. Accordingly, the defendant didn’t pay the IRS $1,000,000 (ONE MILLION DOLLARS) in Withholdings and Payroll Taxes andwas sentenced to 24 months in prison for failing to account for and pay over employment taxes withheld from his employees’ wages, announced Principal Deputy Assistant Attorney General Richard E. Zuckerman of the Justice Department’s Tax Division and U.S. Attorney R. Trent Shores.

When they dragged him from the Courtroom, I thought I heard him say:
“I should have hired Selig & Associates”
(said a Bailiff under the terms of confidentiality)

According to documents and information provided to the Court, the business-owner was responsible for withholding, and paying over to the Internal Revenue Service (IRS) payroll taxes on the wages paid to his employees. For the period January 2014 through June of 2016  he caused a tax loss of approximately $1 million by intentionally not paying to the IRS income and social security taxes withheld from employees’ wages and the employer portion of social security taxes due from on those wages. In addition to prison, the business-owner was ordered to pay restitution to the IRS in the amount of $904,091, and to serve three years of supervised release.

Guilty Plea Leads to Forfeiture of $12,000 Following Seizure of 34,000 Cigars. Bronx man surrenders $12,240 seized in trafficking case

The New York State Department of Taxation and Finance announced that Nasser Albarati, 52, of Edgar Place in the Bronx, pleaded guilty to disorderly conduct in Albany County Court on September 4 and surrendered $12,240 that was seized by Tax Department investigators, along with more than 34,000 untaxed cigars, on June 29, 2018.

“Those who blatantly evade our cigarette and tobacco products tax, depriving communities and the state of revenue needed for vital services and putting honest businesses at an unfair disadvantage, will be held accountable,” said New York State Commissioner of Taxation and Finance Michael Schmidt.

At the time of his arrest, Albarati faced a felony charge after being found with 34,100 untaxed cigars and $12,240 in cash in his possession.

All tobacco products for retail sale in New York State must be purchased by a licensed distributor, and retail dealers must be in possession of purchase invoices showing that the taxes on the tobacco have been paid.

Married Couple Sentenced and Sent to Slammer (Failure to Pay Income Tax is Serious)

A not-so-happy husband and wife were sentenced to 36 and 12 months respectively for violating federal tax laws (not paying income taxes). The lamentable lovebirds were also ordered to pay restitution in the amounts of $1,969,463 and $1,937,267 respectively, which represents unpaid IRS taxes and every penalty the IRS could apply. After that, criminal fines of $250,000 and $100,000 were imposed on the disillusioned duo respectively. And after they were beaten down, broken and bankrupted, both battered defendants wearily agreed to the imposition of a fraud assessment (an additional $3 million dollars). The crestfallen couple has already paid more than $4 million in back taxes and interest (and that still isn’t enough for the IRS).

If you are "playing fast and loose with the rules" call David Selig directly. Selig will get you into legal compliance and do everything possible to help you solve your tax problem.
